Terms of Service

Please read these Terms of Service carefully before booking with ToteRental.ca. By placing a booking, you agree to be bound by these terms. If you have any questions, contact us before proceeding.
1. About ToteRental.ca
ToteRental.ca ("we," "us," or "our") is a moving tote rental service based in Guelph, Ontario, Canada. We rent heavy-duty plastic moving totes and equipment to customers in Guelph, Kitchener, Waterloo, Cambridge, and surrounding areas.

2. Eligibility
To book with ToteRental.ca, you must be:
- At least 18 years of age
- Located within our service area during the rental period
- Capable of entering into a legally binding agreement
3. Bookings and Confirmation
A booking is considered confirmed only once you have received a written confirmation from ToteRental.ca via email or text message. We reserve the right to decline or cancel bookings at our discretion, in which case any payment made will be refunded in full.
When booking, you agree to provide accurate delivery and contact information. Errors in address or scheduling that result in a failed delivery attempt may incur a redelivery fee.
4. Pricing and Payment
All prices are in Canadian dollars (CAD) and include applicable taxes unless otherwise stated. Package pricing is listed on our website and is subject to change. The price confirmed at the time of booking is the price you will be charged.
We accept payment via e-Transfer, credit card, debit card, and cash. Payment is due at or before delivery unless otherwise agreed in writing.
Additional charges may apply for:
- Extended rental periods beyond the agreed return date
- Damaged, broken, or missing totes or equipment
- Cleaning fees if totes are returned in an unsanitary condition
- Failed delivery or pickup attempts due to incorrect information or unavailability
5. Delivery and Pickup
We will deliver and pick up your totes at the address and times agreed at booking. You or an authorized representative must be available to receive delivery and return. If no one is available, we may leave the equipment in a mutually agreed safe location — in this case, risk passes to you upon delivery.
Delivery and pickup times are estimates. While we make every effort to arrive on schedule, we are not liable for delays caused by traffic, weather, or other circumstances beyond our control.
Our service area covers Guelph, Kitchener, Waterloo, Cambridge, Fergus, Elora, Rockwood, and Milton. Bookings outside this area are subject to our approval and may incur an additional delivery fee.
6. Rental Period
Your rental period begins at the time of delivery and ends at the time of pickup, as agreed in your booking. If you need more time, please contact us at least 24 hours before your scheduled pickup. We will do our best to accommodate extensions, subject to availability, and will confirm any updated pricing.
Late returns (without prior approval) will be charged at a daily rate for each additional day beyond the agreed return date.
7. Your Responsibilities as a Renter
By accepting delivery of our equipment, you agree to:
- Use the totes and equipment only for household moving purposes
- Keep the equipment secure and protected from theft or weather damage
- Not sublet, lend, or transfer the equipment to any third party
- Return all totes, lids, and equipment in the same clean condition as received
- Not use totes to transport hazardous materials, chemicals, liquids, or anything that could damage the totes or pose a safety risk
- Promptly report any damage, loss, or theft to us
8. Damage, Loss, and Liability
You are responsible for all equipment from the time of delivery until it is collected by ToteRental.ca. You will be charged for:
- Any totes or lids that are cracked, broken, or rendered unusable — at our replacement cost
- Missing totes, lids, dollies, or other equipment — at our replacement cost
- Damage to dollies or straps beyond normal wear and tear
We will notify you of any damage charges following pickup and provide you with an opportunity to discuss the assessment before charging.
9. Cancellations and Refunds
We understand that moving plans change. Our cancellation policy is:
- 72+ hours before delivery: Full refund
- 24–72 hours before delivery: 50% refund
- Less than 24 hours before delivery: No refund
To cancel, contact us by email at hello@toterental.ca or by phone at +1 (226) 979-0248. Refunds will be issued to the original payment method within 5–10 business days.
If we cancel your booking for any reason, you will receive a full refund.
10. Limitation of Liability
ToteRental.ca is not liable for any indirect, incidental, or consequential damages arising from your use of our equipment or service, including but not limited to damage to items packed in the totes, delays in your move, or losses resulting from equipment failure.
Our total liability for any claim related to a booking shall not exceed the amount you paid for that booking.
Nothing in these Terms limits liability for gross negligence, fraud, or where limitation of liability is not permitted by applicable law.
11. Indemnification
You agree to indemnify and hold harmless ToteRental.ca, its owners, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of our equipment, your breach of these Terms, or your violation of any applicable law.
12. Intellectual Property
All content on the ToteRental.ca website — including text, images, logos, and design — is the property of ToteRental.ca and may not be reproduced, distributed, or used without our written permission.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after any changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
